Ken Codes LLC, doing business as Crouchfarb Farm, provides an online ordering platform for fresh eggs and backyard products.All aspects of our service, including but not limited to order acceptance, fulfillment, delivery, and product availability, are provided at our sole discretion without any guarantees.
Website Availability: We make no guarantees about the availability, reliability, or uninterrupted operation of our website. Our website may be temporarily unavailable due to maintenance, technical issues, server problems, internet outages, or other factors beyond our control. We are not liable for any damages, losses, or inconvenience resulting from website downtime, technical difficulties, or inability to access our services.
3. Marketing Content and Humor Disclaimer
The content on our website, including headlines, descriptions, and marketing copy, contains humor, hyperbole, and satirical elements for entertainment purposes. Claims about chickens having PhD degrees, attending therapy sessions, practicing yoga, or any other extraordinary abilities are fictional and intended for comedic effect.
While we are committed to providing high-quality fresh eggs and excellent customer service, statements about:
- Chickens receiving psychological therapy or education
- 700+ years of family history dating to medieval times
- Eggs having emotional intelligence or feelings
- Supernatural or impossible chicken abilities
- Historical events involving poultry rebellions or plagues
are creative fiction and should not be interpreted as factual claims about our products or services. Our actual eggs are produced by normal, healthy chickens in standard backyard conditions with proper care and nutrition.
4. Account Registration
You may create an account using your email address. We use magic link authentication - no passwords are stored. You are responsible for maintaining the confidentiality of your email account and for all activities that occur under your account.
5. Order Fulfillment and Availability
No Guarantee of Fulfillment: Placing an order does not guarantee fulfillment. We reserve the right to accept, reject, or cancel any order at our sole discretion. Orders are subject to product availability, which may be limited or unavailable without prior notice.
Order Processing: We reserve the right to fulfill orders in any sequence we determine appropriate, regardless of when orders were placed. Factors affecting fulfillment priority may include, but are not limited to, product availability, delivery location, order size, and operational considerations. The order queue displayed on our website is for informational purposes only and does not represent a binding commitment to fulfillment order or timing.
Order Modifications and Cancellations: Orders cannot be modified or cancelled once submitted. All order details must be finalized before submission. If you need to make changes, you must contact us immediately at hello@crouchfarb.farm, but we cannot guarantee that modifications or cancellations will be possible.
Pricing and Payment: Prices are displayed at the time of ordering and may change without notice. In the event of a pricing error on our website, we reserve the right to cancel or refuse orders placed at the incorrect price, even after payment processing. Payment is processed offline after order fulfillment. Product limits may apply to ensure fair distribution. No payment will be collected for unfulfilled orders.

Service Area: Our service area is subject to change at any time. Even if your location was previously serviced, we reserve the right to discontinue delivery to any area without notice. Any delivery times or dates provided are estimates only and do not constitute a commitment or guarantee.
7. Product Quality, Food Safety, and Returns
No Quality Guarantees: All products are provided "as is" without any warranties or guarantees of any kind. Products are subject to natural variation and we make no representations about quality, freshness, size, or any other characteristics.
HEALTH AND FOOD SAFETY WARNINGS:
• EGGS ARE A MAJOR ALLERGEN and may cause severe allergic reactions
• Fresh eggs may or may not require refrigeration - you are responsible for proper storage decisions
• Raw or undercooked eggs may contain harmful bacteria including Salmonella
• Pregnant women, elderly, young children, and immunocompromised individuals should avoid raw eggs
• Cook eggs to an internal temperature of 160°F to ensure safety
• Products may have come into contact with other allergens during production
• Check for cracks before use - do not consume eggs with cracked shells
• You assume all risks associated with fresh egg consumption and storage
Customer Responsibility: Upon delivery, you assume complete responsibility for all aspects of product storage, handling, and use. We are not responsible for any outcomes related to your use of our products, including but not limited to illness, injury, or dissatisfaction.
Returns and Refunds: We may, at our sole discretion, consider quality concerns reported within 24 hours of delivery with photographic evidence. Any remedy, if offered, is entirely discretionary and may include replacement, partial credit, or other accommodation as we deem appropriate. We are under no obligation to provide refunds, replacements, or other remedies.
8. Email Communications
By using our service, you consent to receive email communications. We reserve the right to send or not send any communications at our discretion. Email notifications about orders, deliveries, or any other matters are provided as a courtesy and are not guaranteed. You may manage your email preferences, but we reserve the right to send essential service communications regardless of preferences.

We shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, power outage, pandemic, governmental action, war, terrorism, riot, civil unrest, acts of God, chicken-related incidents (including but not limited to illness, escape, or refusal to lay eggs), or other unforeseeable causes that are beyond our reasonable control.
13. Dispute Resolution and Governing Law
Arbitration: Any dispute arising out of or relating to these Terms or our service shall be resolved through binding arbitration in Denver, Colorado, in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitrator's decision shall be final and binding. Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines that the prevailing party is entitled to recover its fees.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any legal action that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Denver, Colorado, and you consent to the personal jurisdiction of such courts.
14. Electronic Acceptance and Signatures
By using our website, placing orders, or checking the Terms acceptance checkbox, you agree that such electronic actions constitute your legal signature and that you are legally bound by these Terms as if you had physically signed a written agreement. You waive any rights to challenge the validity of electronic signatures and agree that electronic records will be admissible in legal proceedings to the same extent as written documents.
